The Next One’s On Me, Inc. d/b/a Loop & Tie (“Loop & Tie”) respects your privacy.  This Privacy Policy applies to personal data we collect when you access or use our websites, such as www.loopandtie.com, mobile applications, or our other services (collectively, our “Service”). This Privacy Policy describes how we use, store and share your personal data, including when you interact with us outside of the Service, such as through our customer support channels, or on social media pages, and how you may access and update your personal data.

Information You Provide to Us

In general, we receive and collect all information you provide via the Service, telephone, email or in any other way. This includes personal data that can identify or relates to you, including, but not limited to, first and last name, home or other physical address, Zip Code, email address, phone number, payment information or other information you choose to provide.

In a few areas on our Service, we ask you to provide personal data that will enable us to enhance your use of the Service or for purposes such as facilitating correspondence with you, registering your entitlement to access certain special features of the Service or to complete certain transactions. It is always your choice whether or not to provide personal data. We also may periodically obtain both personal and non-personal information about you from affiliated entities, partners and other independent third-party sources.  

Information We Collect Automatically

● Transactional Information: When you make a purchase or return, we collect information about the transaction, such as product and/or service details, purchase price, and the date and location of the transaction.

● Location Information: We may collect information about your approximate location, for example, based on your IP Address.

● Device and Usage Information and Tracking Technologies: We may use cookies, log files, web beacons, device identifiers, advertising identifiers and similar tracking technologies, including those from third-party service providers, to automatically collect your preferences, performance data and information about your web usage when you visit the Site. We may use cookies to optimize the user experience by delivering content specific to your interests, and keep track of your input/output while you are using or visiting our Service. We may collect your IP address, device and Internet service provider information, web browser details and the address of any referring website (e.g. Facebook and Twitter), to help administer our Service, diagnose problems with our servers, and gather demographic information about usage of our Service. We obtain information from other sources. For example, we may collect information from identity verification services, advertising networks and data analytics providers, affiliated entities, partners and other independent third-party sources. Additionally, if you create or log into your account through a third-party platform (such as Facebook or Google), we will have access to certain information from that platform, such as your name, birthday, and profile picture, in accordance with the authorization procedures determined by such platform.

We may derive information or draw inferences about you based on the information we collect. For example, we may make inferences about your approximate location based on your IP address.

How we use Personal Data

We use the information we collect to administer your account. We process your personal data with your consent, as needed to provide you the Service or our other products and services or as specified in this Privacy Policy. We may also use your personal data to personalize your experience with us, comply with legal and financial obligations, operate and protect our business, our customers, or vital or other public interests, or for our other legitimate interests as described in this Privacy Policy. Among other things, we will use your personal data to allow you to use the Service and in assisting you to quickly find information on our Service, for example, by alerting you to product upgrades, special offers, updated information and our other new products and services. We may enhance or merge your personal data collected via the Service with data we have collected from third parties for purposes of marketing products or services to you.

• Detect, investigate, and help prevent security incidents and other malicious, deceptive, fraudulent, or illegal activity and help protect the rights and property of Loop & Tie and others;

• Create de-identified, anonymized or aggregated information; and

• Carry out any other purpose described to you at the time the information was collected.

Information Disclosed to Third Parties

We disclose personal information in the following circumstances or as otherwise described in this policy:

● We disclose personal information to vendors, service providers, contractors and consultants that access personal information to perform work for us, such as companies that assist us with web hosting, payment processing, advertising and marketing, fraud prevention, and customer service.

● If you provide a product review or otherwise share content on our Services, we disclose this information publicly and to other users of our Services.

● If you choose to use integrations we offer on our Services, such as sharing your location through a Google Maps integration, we may disclose certain information with the integration partners.

● We may disclose personal information to third parties for their own services and marketing purposes and with a customer who sends a gift to you in accordance with applicable law.

● We disclose personal information with our lawyers and other professional advisors where necessary to obtain advice or otherwise protect and manage our business interests.

● Personal information is disclosed between and among Loop & Tie and our current and future parents, affiliates, and subsidiaries and other companies under common control and ownership.

● We disclose personal information with your consent or at your direction.

We also disclose aggregated or de-identified information that cannot reasonably be used to identify you.

We may disclose your personal data with our partners, contractors, agents, third party vendors and other service providers for the purpose of performing services or providing products on our behalf. All such parties who have access to your personal data are required to keep the data confidential and not use it for any other purpose than to carry out the services they are performing for us or as otherwise required by law. In addition, information collected about you may be shared with other third parties as expressly stated on the page on which you provided such information. Such parties may include business analytics companies, customer service vendors, communications service vendors, credit card processors, marketing vendors, and fraud prevention vendors. We may also authorize third-party vendors to collect information on our behalf, including as necessary to operate features of the Service or to facilitate the delivery of online advertising tailored to your interests.

We also may disclose your personal data:

In response to subpoenas, court orders, lawful requests by public authorities to meet national security or law enforcement requirements, or other legal process; to establish or exercise our legal rights; to defend against legal claims; or as we believe is otherwise required by law. In such cases we reserve the right to raise or waive any legal objection or right available to us.

When we believe it is appropriate to investigate, prevent, or take action regarding illegal or suspected illegal activities; to protect and defend the rights, interests, or safety of our company, the Service, our customers, or others; or in connection with our Terms of Use and other agreements.

In connection with a financing, corporate transaction, such as a divestiture, merger, consolidation, asset sale, acquisition of all or a portion of our business by another company, or in the unlikely event of bankruptcy.

Other than as set out above, we will attempt to notify you when your personal data will be shared with third parties.

ADVERTISING AND ANALYTICS

We engage others to provide analytics services and serve advertisements across the web and in mobile apps. These entities may use cookies, web beacons, device identifiers, and other technologies to collect information about your use of our Service and other websites and applications, including your IP address, web browser, mobile network information, pages viewed, time spent on pages or in mobile apps, links clicked, and conversion information. This information may be used by Loop & Tie and others to, among other things, analyze and track data, determine the popularity of certain content, deliver advertising and content targeted to your interests on our Services and other websites, and better understand your online activity.

You have certain choices with respect to your personal information, as described below.

Data Subject Requests

To the extent provided by the law of your jurisdiction, you may have the right to: (1) know more about and access the personal information we collect, use, and disclose about you and to receive your data in a portable format, (2) delete your personal information, (3) correct inaccurate personal information, and (4) object to, or request that we restrict, certain processing. California residents can exercise the above rights themselves, or designate an authorized agent to make requests on their behalf.  We will verify your request by asking you to provide information sufficient to confirm your identity, such as your name, email address, and information about your interactions with us. If you would like to use an authorized agent to exercise your rights, we may request evidence that you have provided such agent with power of attorney, or that the agent otherwise has valid signed authority to submit requests on your behalf, and ask that you verify your identity directly with us. You may update and correct certain account information at any time through your profile settings.

International Transfers

We operate in the United States and internationally. At times, for orders originating within the European Economic Area or being delivered to the European Economic Area, we may use third parties located within or outside the European Economic Area to process such orders. Your personal information may be transferred to those third parties in order for us to perform (or take steps to perform) contracts that we enter into with you, or contracts that we enter into with others for your benefit. In the preceding twelve months, Loop & Tie has disclosed the following categories of personal information for business and commercial purposes to the following categories of recipients:

California law requires that we provide transparency about personal information we “sell,” which, for the purposes of the CCPA, broadly means scenarios in which we have shared Personal Information with third parties in exchange for valuable consideration. We “sell” Personal Information for advertising and marketing purposes.

Notice of Financial Incentive

We offer product incentives to prospective and current Loop & Tie users. Consumers may sign up in order to receive product incentives. As such, under the CCPA, our product incentives may be considered financial incentives provided in exchange for the collection and retention of personal information.

We offer these product incentives to enhance our relationship with you. There is no obligation to opt-in and consumers may opt-out at any time. The details of each program are contained in each such program offering.

The consumer data received in exchange for your participation is dependent on a number of factors, including, for example, whether and to what extent you take advantage of any offerings and whether and to what extent you opt out of any offerings but is roughly equivalent to the value of the product offered.

Sensitive Personal Information

We obtain consent to collect information that is considered “sensitive personal information” where consent is required. If we notify you that we collect sensitive personal information, that means that we collect sensitive personal information within the meaning of the law of that particular state.

Retention of Personal Information

We will retain your information only as long as necessary for the purposes outlined in this Privacy Policy, and for a commercially reasonable time thereafter for backup, archival, fraud prevention or detection or audit purposes, or as otherwise required by law.

Other Details about Our Information Practices

We do not knowingly sell or share the personal information of consumers who are under the age of 16.

You have the right to opt out of the sale or sharing of your Personal Information by us.

Consumers who opt-in to personal information sales may opt-out of future sales at any time.

Additional Privacy Information

Third-Party Sites

Please be aware that other web sites that may be accessed through our Service may collect personally identifiable information about you. This Privacy Policy applies only to our Service and does not cover the information practices of those third-party web sites linked to our Service. The privacy policies located on such third party web sites shall apply and we do not control such policies or the privacy practices of third parties.

We use a third party payment processor, Stripe, to process payments made to us.  Stripe’s use of your personal information is governed by their privacy policy, which may be viewed at https://stripe.com/privacy.

Children’s Privacy

Our Service is not intended to be used by users under the age or 18. Those under 18, may still receive gifts through the Service. Any user who provides their information through the Service represents that he or she is 18 years of age or older.

Updates to this Privacy Policy

This is our entire and exclusive Privacy Policy and it supersedes any earlier version. We may change this Privacy Policy by posting a new version of this Privacy Policy, or by other methods, such as sending you a notification through the Service. We encourage you to review this page periodically. When we do change the policy, we will also revise the “last updated” date at the Privacy Policy.
